1. Acceptance of These Terms
These Terms and Conditions (“Terms”) govern your access to and use of the website located at www.dagswmo.org and any related pages, forms, administrative tools, and features operated by Dress A Girl Southwest Missouri (“DAGSWMO,” “we,” “us,” or “our”) (collectively, the “Website”). By accessing or using the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website.
Your use of the Website is also subject to our Privacy Policy, which describes how we collect, use, share, and protect information. The Privacy Policy is a statement of our information practices and is not incorporated into these Terms. Please review the Privacy Policy before using the Website.
These Terms apply to all visitors and users of the Website, including members of the public, volunteers, sponsors, donors, and authorized administrative users, as applicable.
2. About DAGSWMO
DAGSWMO is an independent, volunteer-driven Missouri nonprofit corporation, organized as a 501(c)(3) public charity, with local DAGSWMO chapters in Cassville, Monett, and Springfield. We sew and distribute dresses, skirts, and shorts to girls and boys in need locally and through partner missionaries internationally.
The Website is primarily an informational resource about our mission, programs, events, and ways to support our work. Certain administrative features may be available only to authorized DAGSWMO personnel and are not available to the public.
3. Eligibility and Age Requirement
The Website may be viewed by general audiences, but our forms, registrations, donations, volunteer signups, and other information submissions are intended for individuals 18 years of age or older. If you are under 18, you may use the Website or submit information only with the involvement and permission of a parent or legal guardian. The parent or legal guardian is responsible for the minor’s use of the Website and will be treated as the responsible contact.
By using the Website or submitting information through the Website, you represent that you meet these requirements.
4. Privacy
We respect your privacy. Our collection and use of personal information through the Website, including information you submit through volunteer, newsletter, sponsor, contact, event, donation, SMS, and email communications, is described in our Privacy Policy. By using the Website, you acknowledge that you have read the Privacy Policy.
5. Information You Submit
When you complete a form on the Website, such as but not limited to a volunteer signup, newsletter subscription, or when you send us a message, including through any free-text “notes” or “message” field, the following terms apply.
- Permission to use your submission. You give DAGSWMO permission to use, store, copy, process, and respond to the information and content you submit for the purpose of operating our Website, communicating with you, maintaining our records, and carrying out our charitable programs. This permission is limited to those purposes and does not transfer ownership of your content to us.
- You're responsible for what you submit. You confirm that, to the best of your knowledge, any information or content you submit is accurate, that you have the right to provide it, and that it does not violate the law, infringe someone else’s rights, or contain defamatory, harmful, or otherwise inappropriate content.
- No obligation to use or retain. We are not obligated to use, display, store, respond to, or return any content you submit, and we may remove, decline to use, or delete any submission at our discretion, subject to any legal or recordkeeping obligations that may apply.
6. Intellectual Property
6.1 Our Content
Except as noted below, the content on the Website, including text, graphics, photographs, images, layouts, and the selection and arrangement of that content, is owned by DAGSWMO or used by us with permission, and is protected by copyright, trademark, and other intellectual property laws. You may view and use the Website for personal, informational, volunteer, donor, sponsor, or other lawful purposes related to DAGSWMO. You may not copy, reproduce, modify, distribute, sell, or exploit Website content without our prior written permission, except as allowed by law.
6.2 Names, Logos, and Branding
“DAGSWMO” and “Dress A Girl Southwest Missouri” are names used by our organization. We do not claim that those names are federally registered trademarks unless expressly stated. The “Dress a Girl Around the World” name and logo are the property of their respective owner, and DAGSWMO uses the Dress a Girl Around the World logo with permission.
Nothing on the Website grants you any right or license to use the names, logos, trademarks, service marks, or branding of DAGSWMO, Dress A Girl Southwest Missouri, Dress a Girl Around the World, or any third party without the appropriate owner’s prior written permission.
References to Dress a Girl Around the World are for mission-related and informational purposes. DAGSWMO is an independent organization and is not a chapter, subsidiary, fiscal sponsor, agent, or legal representative of Dress a Girl Around the World, Dress a Girl Missouri, or any other organization.
6.3 Third-Party Materials
The Website may include or link to third-party materials, including sewing patterns, fonts, photographs, logos, embedded content, maps, social media features, donation tools, and other resources. Third-party materials remain the property of their respective owners and may be subject to their own license terms, terms of use, or privacy policies.
Photographs supplied by partner missionaries, volunteers, sponsors, or other third parties are used by DAGSWMO with permission or as otherwise allowed by law. Please do not copy, download, reuse, or redistribute photographs from the Website without permission.
6.4 Permitted Use
The content on the Website is provided for personal, informational, volunteer, donor, sponsor, and other lawful purposes related to DAGSWMO. You may view the Website and share links to public pages of the Website.
Because some photographs and images may include children, mission recipients, volunteers, or private event participants, you may not download, copy, screenshot, reproduce, republish, distribute, modify, or reuse any photographs, images, videos, or other Website content in any medium or for any purpose without our prior written permission, except where we expressly make specific materials available for download or sharing.
All rights not expressly granted are reserved.
7. Photographs and Media
Photographs, videos, and other media displayed on the Website are owned by DAGSWMO or used by us with permission. Visitors may not download, screenshot, copy, reproduce, republish, distribute, modify, or reuse photographs, videos, or other media from the Website without our prior written permission except where we expressly make specific materials available for download or sharing.
This restriction helps protect the privacy, dignity, and safety of volunteers, event attendees, children, mission recipients, and others who may appear in our photographs or media.
How we obtain consent for the photographs and media we publish, and how you may request removal of an image in which you or your child appears, are described in our Privacy Policy. To request removal, please email info@dagswmo.org.
8. Copyright Complaints
We respect the intellectual property rights of others. If you believe that content on the Website infringes your copyright or other intellectual property rights, please email info@dagswmo.org with:
- a description of the work you believe has been infringed;
- the location or URL of the material on the Website that you believe is infringing;
- your name and contact information; and
- a brief explanation of why you believe the use is unauthorized.
We will review legitimate complaints and may remove or disable access to material when we determine it is appropriate.
9. Donations and Fundraising
Voluntary gifts. Donations to DAGSWMO are voluntary. We are deeply grateful for your support.
Processed by third parties. Donations are processed by third-party payment processors, such as Zeffy, PayPal and Venmo, on their own platforms and subject to their terms and privacy policies. DAGSWMO does not receive, process, or store your credit card number, bank account number, or other financial account details through the Website.
Refunds. Donations are generally non-refundable. If you believe you made a mistake or duplicate gift, please contact us at info@dagswmo.org, and we will work with you in good faith in resolving it. Refunds, if available, may be subject to the policies, timing, and fees of the applicable payment processor.
Recurring gifts. If you set up a recurring or monthly donation, it will continue until you cancel it. Because recurring gifts are managed by the third-party payment processor, you may need to cancel or change a recurring donation through that processor’s app, website, or account tools. DAGSWMO may not be able to stop or modify a recurring gift on your behalf.
Tax matters. DAGSWMO is a 501(c)(3) organization, and gifts may be tax-deductible to the extent allowed by law. DAGSWMO does not provide tax, legal, or financial advice. You are responsible for confirming the deductibility of your gift and retaining your own records and receipts. Please consult your own tax advisor with questions.
Amazon Wishlists. Links to our Amazon Wishlist pages allow you to purchase and ship supplies to us directly through Amazon. Those purchases are transactions between you and Amazon under Amazon’s terms and privacy policy. DAGSWMO does not receive your payment information for Amazon Wishlist purchases.
10. Sponsorships
If you submit a sponsor form on behalf of an organization, the following terms apply.
Recognition, not endorsement. Displaying a sponsor’s name, logo, website, or other information on the Website means only that the organization has supported or expressed interest in supporting DAGSWMO. It does not mean that DAGSWMO recommends, guarantees, or endorses the sponsor’s products, services, views, actions, or organization. It also does not mean that the sponsor speaks for DAGSWMO or that DAGSWMO speaks for the sponsor. A sponsor’s support of DAGSWMO does not imply the sponsor’s endorsement of DAGSWMO’s actions, beliefs, or activities.
Submission expresses interest only. Submitting a sponsorship form expresses interest only and does not create a binding sponsorship agreement. Any actual sponsorship benefits, logo placement, payment terms, event commitments, recognition levels, or other sponsorship terms may require separate written approval or a separate sponsorship agreement.
Use of sponsor information. By submitting a sponsor form, you confirm that you are authorized to provide the sponsor’s name, logo, website, and other submitted information to DAGSWMO and that DAGSWMO may use that information for sponsorship review, communication, recordkeeping, and approved recognition purposes.
Changes or removal. DAGSWMO may decline, modify, suspend, or remove sponsor recognition at any time when we believe it is appropriate to protect DAGSWMO, the Website, our mission, or the people we serve.
Information about how sponsor information is collected, displayed, and kept is described in our Privacy Policy.
11. Volunteering and Events
- Expression of interest. Signing up to volunteer or attend an event through the Website is an expression of interest and does not create a binding obligation on you or on DAGSWMO.
- Participation is at your own risk. Participation in DAGSWMO activities, volunteer opportunities, meetings, and events is voluntary. To the fullest extent permitted by law, you are responsible for your own conduct and assume the ordinary risks associated with attending or participating in any DAGSWMO event or activity.
- Separate waivers or agreements. This section does not replace, limit, or supersede any separate waiver, release, consent, code of conduct, safety policy, photo/media consent, or other agreement you may be asked to sign or accept at or in connection with a specific event or activity. Any such separate agreement remains in effect according to its terms.
- Optional contributions. Some events may include an optional “love offering” or other voluntary contribution. Any such contribution will be voluntary and is treated as a donation under Section 9.
12. SMS Messaging Terms
If you opt in to receive SMS text messages from DAGSWMO, the following terms apply. These terms are intended to be consistent with the SMS section of our Privacy Policy.
How to opt in. You may opt in by checking the clearly labeled, unchecked-by-default "Text me updates" box on our volunteer signup form at https://www.dagswmo.org/volunteers, or by providing your consent on a paper signup form later transcribed into our systems. By opting in, you consent to receive recurring SMS reminders and updates from DAGSWMO at the mobile number you provide.
- Sender. Messages are sent from +1 (833) 600-1888, a toll-free number used by DAGSWMO.
- Message content. Messages may include volunteer coordination, event reminders, chapter updates, and other operational or mission-related communications.
- Message frequency. Message frequency varies based on chapter activity and your involvement with DAGSWMO but is typically 1-2 messages per month per recipient.
- Voluntary consent. Consent to receive SMS messages is voluntary and is not required as a condition of donating, volunteering, attending an event, or otherwise supporting DAGSWMO.
- Carrier charges. Message and data rates may apply. DAGSWMO is not responsible for charges from your mobile carrier, and mobile carriers are not liable for delayed or undelivered messages.
- Opting out. You may opt out at any time by replying STOP to any SMS message from DAGSWMO to unsubscribe. We do not send a reply confirming your opt-out; we simply stop, and we will not send further SMS messages unless you opt in again by replying START or otherwise giving us permission. Your mobile carrier may send its own automatic confirmation message, which is outside our control.
- Help. Reply HELP for assistance or email info@dagswmo.org.
- Privacy. Information we collect through the SMS program, including your phone number, opt-in record, and any replies you send, is handled as described in our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
13. Email Communications
We send newsletters, event invitations, and operational updates by email only to recipients who have opted in. Every marketing email includes a one-click unsubscribe link, and you may also email info@dagswmo.org to be removed. Details of our email practices, including our double opt-in process, are described in our Privacy Policy.
14. Third-Party Services and Links
The Website contains links to, and embedded features from, third-party websites and services, including our donation processors (such as Zeffy, PayPal, and Venmo), Amazon Wishlist pages, Google Maps, our social media pages such as Facebook, media served through Cloudflare, and external sewing pattern or mission-related resources such as Dress a Girl Around the World and Etsy.
These third-party sites and services are operated by others and are governed by their own terms and privacy policies. DAGSWMO does not control them and is not responsible for their content, availability, products, services, fees, transactions, downloads, or practices. Your use of any third-party site or service is at your own risk, and we encourage you to review their terms and privacy policies before using them.
15. Acceptable Use
When using the Website, you agree that you will not:
- Use the Website for any unlawful purpose or in violation of these Terms;
- Scrape, harvest, or collect email addresses, phone numbers, or other contact or personal information from the Website;
- Use bots, scripts, or other automated means to access the Website or to submit spam, repeated, false, or abusive form submissions, except for ordinary use by search engines, accessibility tools, or other tools that do not harm or burden the Website;
- Attempt to gain unauthorized access to the Website, the administrative area, any account, or any system or network, or attempt to breach, test, scan, bypass, or circumvent any security measure;
- Introduce, upload, or transmit viruses, malware, or other harmful code;
- Impersonate any person or organization or misrepresent your affiliation with any person or organization;
- Harass, threaten, abuse, exploit, or harm others, or submit content that is infringing, obscene, defamatory, deceptive, harmful, or otherwise unlawful;
- Interfere with, disrupt, damage, or overload the Website or its infrastructure; or
- Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying structure of any non-public part of the Website, except as permitted by law.
16. Enforcement
We may monitor use of the Website, but we are not obligated to do so. We may also take any action we reasonably believe is necessary to protect the Website, DAGSWMO, our users, or others. We may restrict, suspend, or block access to the Website, including blocking an IP address for any violation or suspected violation of these Terms, misuse of the Website, security concern, or other activity we believe may be harmful or unlawful. We may also report suspected illegal activity to law enforcement and cooperate with any resulting investigation, legal process, or request from public authorities.
17. Disclaimers
The Website is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, DAGSWMO disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Website will be uninterrupted, error-free, secure, or free of harmful components, or that any information on the Website will always be accurate, complete, or current.
Content on the Website is provided for general informational purposes only and is not professional advice of any kind, including legal, medical, financial, tax, or safety advice. Any sewing, program, event, safety, or other information is provided without warranty, and you rely on it at your own discretion and risk. You should consult a qualified professional before acting on information where professional advice is appropriate.
18. Limitation of Liability
To the fullest extent permitted by Missouri law, DAGSWMO, including its directors, officers, volunteers, employees, staff, and agents (collectively, the “Released Parties”), will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, goodwill, profits, or other intangible losses, arising out of or related to your use of, or inability to use, the Website, even if the Released Parties have been advised of the possibility of such damages.
To the fullest extent permitted by law, the total aggregate liability of the Released Parties for any and all claims arising out of or related to the Website will not exceed one hundred dollars (US $100).
Some jurisdictions do not allow limitations on certain types of damages. In those jurisdictions, the Released Parties’ liability will be limited to the maximum extent permitted by law.
19. Indemnification
You agree to indemnify, defend, and hold harmless DAGSWMO and its directors, officers, volunteers, employees, staff, agents, and representatives from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your misuse of the Website, your violation of these Terms, your violation of any law or third-party right, your unauthorized access to or use of the Website, or any content or information you submit through the Website.
20. Dispute Resolution and Governing Law
- Informal resolution first. Before filing any claim, you agree to first contact us at info@dagswmo.org and work with us in good faith to resolve the dispute informally. You agree to allow at least sixty (60) days from the date you notify us for the parties to attempt to resolve the matter before starting any formal proceeding, unless urgent legal action is reasonably necessary to prevent harm, protect safety, stop unauthorized use of content or photographs, protect intellectual property rights, or protect the Website or its systems.
- Governing law. These Terms and any dispute arising out of or relating to them or the Website are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules.
- Venue. If a dispute is not resolved informally, you agree that it will be brought exclusively to the state or federal courts located in Greene County, Missouri, unless applicable law requires otherwise. You consent to the personal jurisdiction of those courts.
21. Accessibility
We want the Website to be usable by as many people as possible. If you encounter an accessibility barrier while using the Website, or if you need assistance accessing information on the Website, please contact us at info@dagswmo.org and we will make reasonable efforts to help.
22. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last Updated” date at the top of this page. Changes are effective when posted. Your continued use of the Website after we post changes means you accept the updated Terms. Please review these Terms periodically.
23. General
- Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
- Entire agreement. These Terms, together with any other notices, policies, waivers, consents, or agreements that expressly apply to the Website or a specific Website feature, event, activity, or service, constitute the entire agreement between you and DAGSWMO regarding your use of the Website and supersede any prior agreements on that subject. The Privacy Policy is not incorporated into these Terms.
- Assignment. You may not assign or transfer these Terms without our prior written permission. We may assign these Terms to a successor organization or in connection with a merger, restructuring, dissolution, transfer of programs, or similar organizational change.
- Force majeure. DAGSWMO is not liable for any failure or delay caused by events beyond our reasonable control, including acts of God, natural disasters, severe weather, utility or internet outages, service-provider failures, labor disruptions, governmental actions, emergencies, or actions of third parties.
24. Administrative Access and Authorized Users
Certain areas or features of the Website may be restricted to authorized DAGSWMO personnel, volunteers, or service providers. If you are given access to administrative tools, you agree to use them only for authorized DAGSWMO purposes, to keep your login credentials secure, and not to share your account with anyone else.
You are responsible for activity that occurs through your account unless caused by DAGSWMO’s systems or circumstances outside your reasonable control. You agree to notify DAGSWMO promptly if you believe your account has been compromised or used without authorization.
DAGSWMO may suspend, limit, or revoke administrative access at any time when we believe it is necessary to protect the Website, our organization, our users, or the information we maintain.
